Is Free speech or Stalking a threat?

 Is the direct form of communication and the public messages which in posted on social networking sites same?
One of the incident happened that raises this question of whether public posting on social networking service can amount to staking if they are deemed threatening to another person.
a Federal criminal case involving a man accused of tweeting thousands of vehement messages aimed at a Maryland based Buddhist leader tests the question.
According to the new york times, william lawrence cassidy is accused of online stalking beacause of 8000 twitter and blog entries for that cassidy is now in jail.
this is the only one example of such cases ofcourse the twitter has established itself as a means of broadcasting information to wide group of people all at once but we have to use this positively only for the good cause..
